1. Acceptance of Terms

By downloading, installing, or using Lift ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms apply to all users of Lift on both Android and iOS platforms.

2. About Lift

Lift is a daily mental wellness companion app developed and published by Novasen LLC, a Utah limited liability company. The App is designed to provide daily encouragement, mood tracking tools, and supportive messages to individuals navigating mental wellness challenges including depression and anxiety.

3. Not a Medical Device or Therapy Replacement

Lift is NOT a medical device and does not diagnose, treat, cure, or prevent any medical condition. The App is a personal wellness and encouragement tool only. It is not a substitute for:

• Professional medical treatment or advice
• Licensed therapy or psychological counseling
• Psychiatric care or medication management
• Crisis intervention services
• Emergency medical services

If you are experiencing a mental health emergency, thoughts of self-harm, or suicidal ideation, please call 911 or contact the 988 Suicide & Crisis Lifeline (call or text 988) immediately. You can also reach the Crisis Text Line by texting HOME to 741741.

4. Eligibility

Lift is intended for users aged 18 and older. By using the App you represent that you are at least 18 years of age. The content and subject matter of Lift is designed for adults navigating mental health challenges.

5. License to Use

Novasen LLC grants you a limited, non-exclusive, non-transferable, revocable license to use Lift for your personal, non-commercial purposes. You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer or attempt to extract the source code
• Use the App for any unlawful purpose
• Sell, rent, or sublicense the App to any third party

6. Subscriptions and In-App Purchases

Lift offers optional premium subscription plans ("Lift Premium") that unlock additional features. Subscriptions are processed through Google Play (Android) and the Apple App Store (iOS).

• Billing: Subscriptions are billed through your app store account at the rates displayed at time of purchase.
• Free Trial: A 7-day free trial may be available for new subscribers. Your subscription will automatically renew unless cancelled before the trial period ends.
• Cancellation: You may cancel your subscription at any time through your Google Play or Apple App Store account settings. Cancellation takes effect at the end of the current billing period.
• Refunds: Refund requests are handled by Google or Apple in accordance with their respective refund policies.

7. Your Data and Privacy

Lift is designed as a fully offline, private application. All data you enter remains on your device. Novasen LLC does not collect, store, or transmit your personal data. Please review our Privacy Policy for full details.

8. Sensitive Content and Mental Health

Lift is designed for people navigating mental wellness challenges. We take this responsibility seriously. The App is intended to provide encouragement and support, not to replace professional care. If you are in crisis, please seek immediate professional help.

9. Disclaimer of Warranties

Lift is provided "as is" and "as available" without warranties of any kind, express or implied. Novasen LLC does not warrant that the App will be uninterrupted, error-free, or free of viruses. Your use of the App is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by law, Novasen LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Lift, including but not limited to damages for personal injury, loss of data, or loss of revenue. Novasen LLC's total liability to you shall not exceed the amount you paid for the App in the twelve months preceding the claim.

11. Individual Results

Mental wellness journeys are deeply personal. Results from using Lift will vary from person to person. Novasen LLC makes no guarantees regarding outcomes. The App is one supportive tool among many and should be used alongside professional care where appropriate.

12. Third-Party Links and Services

Lift may contain links or references to third-party services such as NAMI, ADAA, and the 988 Crisis Lifeline. Novasen LLC is not responsible for the content, privacy practices, or availability of these third-party services.

13. Changes to These Terms

Novasen LLC reserves the right to modify these Terms at any time. Material changes will be reflected in an updated effective date. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Salt Lake County, Utah.
